SPECIAL TERMS AND CONDITIONS OF PARTICIPATION
"Tarja – Frisson Noir (Official Fan Legacy Video)" Promotion
- Organizer
The competition "Tarja – Frisson Noir (Official Fan Legacy Video)" (the "Competition") is organized by Edel Music & Entertainment GmbH ("Edel Music" or the "Organizer").
These Special Terms and Conditions supplement the General Competition Terms and Conditions of Participation available at:

In the event of any conflict between these Special Terms and the General Terms and Conditions of Participation, these Special Terms shall prevail.
The Competition is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, TikTok, YouTube, or any other social media platform. Such platforms are not available as contact partners for this Competition.
- Participation in the Competition & Prize
Participation is open worldwide to natural persons who are at least eighteen (18) years of age at the time of entry.
Participation is free of charge and does not require the purchase of any goods or services.

Each participant may only participate once. If multiple videos are submitted by the same participant, only one submission will be considered as a single entry in the random draw.
The prize consists solely of the inclusion of selected participant video footage in the official long-form and/or short-form "Tarja – Frisson Noir (Official Fan Legacy Video)" productions and related promotional activities.
No monetary compensation, royalties, appearance fees, reimbursement, or other remuneration shall be payable.
The prize is personal, non-transferable, non-exchangeable and cannot be redeemed for cash or substituted.
Participants acknowledge that selection in the random draw does not guarantee inclusion in the final video production.
- Participation Period and Winner Determination
The Competition runs from 08 June 2026, 10:00 a.m. CEST until 11 June 2026, 10:00 a.m. CEST.
Only submissions received during the participation period will be considered.
Submissions that violate applicable laws, copyright laws, trademark rights, personality rights, platform guidelines, or these Terms may be removed without notice and excluded from participation.
Following the closing date, selected participants will be determined by random draw from all eligible submissions received during the participation period.
Selected participants will be notified using the contact details provided in the submission form.
If a selected participant cannot be contacted, does not respond within forty-eight (48) hours after notification, or is found to be ineligible, the Organizer reserves the right to select an alternative participant at random.
The Organizer's decision shall be final.
- Submission Requirements and Participant Warranties
By submitting a video, the participant represents and warrants that:
a) the submitted material was created by the participant or that the participant possesses all rights necessary to submit the material and grant the rights described herein;
b) the submission does not infringe any copyright, neighboring right, trademark, design right, privacy right, publicity right, personality right or any other right of any third party;
c) all identifiable individuals appearing in the submission have provided all necessary permissions and consents for the uses described in these Terms;
d) the submission does not contain unauthorized third-party music, audiovisual content, trademarks or other protected material;
e) the participant has full authority to grant the rights described in these Terms.
The participant shall be solely responsible for any claims arising from the submitted material.
The participant agrees to indemnify and hold harmless Edel Music & Entertainment GmbH, earMUSIC, their affiliated companies, employees, representatives and partners against any third-party claims, damages, losses, costs and expenses, including reasonable legal fees, arising from any breach of these warranties.
- Grant of Rights
By submitting a video, the participant grants Edel Music & Entertainment GmbH, earMUSIC, their affiliated companies, successors, licensees, distribution partners and assigns a non-exclusive, worldwide, transferable, sublicensable and royalty-free right, for the duration of the applicable copyright and neighboring-rights protection periods, to:
- reproduce, copy, digitize, store and archive the submitted material;
- edit, adapt, shorten, crop, modify and otherwise transform the submitted material;
- combine the submitted material with other content;
- synchronize the submitted material with music, sound recordings and audiovisual productions;
- publish, distribute, communicate to the public, broadcast and make available online;
- use the submitted material in whole or in part in all media and formats now known or developed in the future;
- use the submitted material for promotional, marketing, advertising, public relations, editorial and commercial purposes relating to Tarja, earMUSIC and/or Edel Music.
The granted rights include use through websites, streaming services, digital service providers, social media platforms, video-sharing platforms and other third-party distribution channels worldwide.
Participants acknowledge that the submitted material may be edited, shortened, combined with other content and otherwise adapted at the Organizer's sole editorial discretion. To the extent permitted by law, participants waive any right to object to such editing or adaptation.
The participant retains ownership of the original submission.
The Organizer shall have no obligation to publish, include, use or otherwise exploit any submitted material, regardless of whether the participant has been selected through the random draw.
- Name, Image and Voice Consent
By participating in the Competition and submitting a video, participants expressly consent to the use of their name, image, likeness, voice, appearance and performance as incorporated in the submitted material.
Where selected, the participant's first and last name may be displayed, credited or otherwise published in connection with the official fan video productions and related promotional activities.
The participant acknowledges that the completed videos may remain publicly available indefinitely, including after the Competition has ended.
- Miscellaneous and Data Privacy
The participant acknowledges that this Competition is in no way connected with Facebook, Instagram, TikTok, YouTube or any other social media platform and is in no way sponsored, endorsed, administered by or associated with such platforms.
Personal data provided by participants, including name, email address and submitted content, will be processed solely for the purposes of administering the Competition, selecting participants, communicating with participants, producing the official fan video productions and exercising the rights granted under these Terms.
The legal basis for such processing is Article 6(1)(b) GDPR (performance of a contract) and, where applicable, Article 6(1)(a) GDPR (consent).
Where a participant's submission is selected and incorporated into the final productions, the participant acknowledges that their name, image, likeness and/or voice may be published worldwide via websites, social media platforms, streaming services and video-sharing platforms.
Participants further acknowledge that content published online may be copied, shared, archived, indexed by search engines or otherwise distributed by third parties beyond the Organizer's control.
Participant data that is no longer required for the administration of the Competition will be deleted in accordance with applicable legal retention requirements. Content incorporated into the final productions may continue to be processed and made publicly available as necessary for the purposes described in these Terms.
Participants have the rights granted under applicable data protection laws, including the right to access, rectify, erase, restrict processing, object to processing where applicable, and lodge a complaint with a competent supervisory authority.

The Organizer reserves the right to modify, suspend, extend or terminate the Competition at any time if circumstances beyond its reasonable control make this necessary for legal, technical or operational reasons.
The Organizer further reserves the right to exclude participants who provide false information, attempt to manipulate the Competition, violate these Terms, or otherwise engage in improper conduct.
- Liability
The Organizer shall be fully liable for intent, gross negligence and damages resulting from injury to life, body or health.
In cases of slight negligence, liability shall be limited to breaches of essential contractual obligations and to foreseeable damages typical for this type of agreement.
Nothing in these Terms shall exclude liability where such exclusion is prohibited by applicable law.
- Applicable Law
The Competition shall be governed by the laws of the Federal Republic of Germany.
Mandatory consumer protection rights and mandatory provisions of the participant's country of residence shall remain unaffected.
Legal recourse is excluded to the extent permitted by applicable law.
- Acceptance of Terms
By participating in the Competition, participants confirm that they have read, understood and accepted these Special Terms and Conditions of Participation, the General Competition Terms and Conditions of Participation and the earMUSIC Privacy Policy.
